Privage App Co., Ltd. (hereinafter referred to as “Privage”) provides a membership card and loyalty point system (Loyalty Program) through the website https://privageapp.com and other related platforms, with the objective of enabling businesses (hereinafter referred to as “Businesses”) to use such system in their operations and to build customer relationships.
By using the services of Privage, Businesses are deemed to have accepted the following Terms and Conditions of Use.
1. Provision of Services by Privage
Privage provides an online membership card and loyalty point system which Businesses may use to create Loyalty Programs and customer relationship activities. Businesses shall have full rights to manage the data within their own designated Workspace.
2. Definitions
Privage means Privage App Co., Ltd., the provider of the membership card and loyalty point system.
Business means any organization or entity that subscribes to Privage services.
End User means a customer or member of a Business who uses the membership card and loyalty point system.
Workspace means a system created exclusively for each Business to operate and manage its data.
3. Purpose of Use
The purpose of Privage’s services is to assist Businesses in effectively managing their Loyalty Programs and membership cards for End Users. Privage shall provide technological support to ensure smooth operation of the system.
4. Registration and User Account
Businesses must register and create an account to access the services. Businesses are responsible for maintaining the confidentiality of their usernames and passwords and for all activities occurring under their accounts.
5. Service Fees and Payment
5.1 Businesses agree to pay service fees according to the package or conditions specified by Privage.
5.2 Privage reserves the right to adjust prices, with prior notice to Businesses within a reasonable period.
5.3 Refunds shall be made in accordance with the Refund Policy announced by Privage.
6. Termination of Services
Businesses may terminate the services in accordance with the procedures specified by Privage. Any refunds (if applicable) shall be processed pursuant to Privage’s Refund Policy.
7. Legality of Business and Data Ownership
7.1 Businesses using the Privage system must operate in compliance with the law. If Privage determines that a Business is engaged in illegal activities under Thai law, Privage reserves the right to immediately suspend the use of the system without liability for any damages incurred by the Business.
7.2 All data stored within the Workspace shall be deemed the property of the Business. Businesses shall have the right to export such data from the system at any time, and Privage shall reasonably facilitate such actions.
8. Limitation of Liability of Privage
8.1 Privage shall not be liable for any damages arising from improper use of the system by Businesses or End Users.
8.2 Privage shall not be liable for damages arising from failures of internet communication, deficiencies of third-party service providers, or force majeure events beyond the control of Privage.
8.3 In cases where data leakage or unauthorized access occurs due to the negligence of the Business itself, such as removing data from the system and causing it to be leaked to third parties or criminals, Privage shall bear no liability for any damages incurred.
8.4 Privage provides Businesses with End User consent information. If a Business acts beyond the scope of such consent or in contradiction to the End User’s granted consent, resulting in lawsuits or disputes, Privage shall not be responsible for any damages or claims arising therefrom.
9. Intellectual Property
All rights in software, trademarks, content, and technology related to the services are the property of Privage. Businesses shall not copy, modify, alter, or use them for other purposes without prior written consent from Privage.
10. Suspension or Termination of Services by Privage
Privage reserves the right to suspend or terminate services to any Business found to be in violation of these Terms or causing harm to the system or other parties.
11. Amendments to the Terms
Privage reserves the right to amend or modify these Terms and Conditions as deemed appropriate, with prior notice to Businesses through channels considered appropriate by Privage.
12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Thailand. Any disputes arising hereunder shall be subject to the jurisdiction of Thai courts.
